COVID-19 Federal Vaccine Mandate

The COVID-19 pandemic continues to affect all aspects of our lives.  From the onset, BNSF's goals have remained the same: keep our people safe and maintain our essential operations.  While we maintained that the decision to be vaccinated for COVID-19 is a personal one, we also encouraged employees to consider the options and make the best decision for themselves and their families.


Under President Biden’s COVID-19 Action Plan, BNSF is covered by the federal mandate requiring vaccination.  Effective December 8, 2021, BNSF has paused its implementation of the COVID-19 vaccine mandate given the dynamic legal proceedings.  The ultimate outcome of the federal contractor vaccine mandate is yet to be determined. It is still possible that the mandate, as it applies to BNSF, could be upheld in court in the near future.  If this happens, BNSF employees would be required to be vaccinated.

Our in-house lawyers serve as critical advisors on all aspects of our operations, helping to ensure our railroad runs smoothly and our customers are well served. We are seeking a high performing, experienced attorney to be a strategic partner and advisor to business unit leaders with responsibility for a substantial portfolio of sophisticated commercial and regulatory matters.


This position has the potential to be a hybrid position with up to 50% remote work.



  • Oversight of and direct involvement in sophisticated regulatory proceedings before the U.S. Surface Transportation Board and other federal agencies;
  • Negotiating and drafting critical contracts with our customers;
  • Management of complex and sophisticated commercial and regulatory litigation;
  • Consulting government affairs personnel regarding legislative issues;
  • Advising and counseling business unit leaders, including senior leaders, on legal issues affecting the company’s commercial and financial performance.




  • Qualified candidates must have a Juris Doctor and current law license (Texas preferred; but not mandatory);
  • Strong academic background;
  • Experience at a large law firm preferred, but not required;
  • 5+ years of relevant work experience as a practicing lawyer (in-house, law firm or government) focused on handling regulatory, commercial, administrative and/or commercial litigation; experience gained from work in the railroad or other transportation or regulated industries a plus;
  • Must have the ability to manage a large and diverse portfolio of clients and issues, often with short and competing deadlines;
  • Must possess excellent legal research, verbal and written communication skills and ability to handle complex and challenging assignments;
  • Must have ability to identify, prioritize and resolve issues quickly and effectively in a positive, commercial, and practical manner;
  • Must have ability and commitment to work both independently and collaboratively with numerous people at all levels throughout the company;
  • Must be proficient in use of Microsoft Office Suite, Lexis/Nexis research system and other web-based legal research tools;
  • Resume, references, non-confidential writing samples, and law school transcript may be required.
